Mark Lynch, who was disqualified from driving, had stolen a Ford Transit Van, was under the influence of alcohol and was driving on the wrong side of the road when he hit Mr Milligan's car head-on in Lanarkshire, Scotland in 2004. As a result, Mr Milligan suffered severe and horrific injuries and now requires 24 hour round the clock care.
Lord Woolman, at the Court of Session in Edinburgh has made an award of almost £2.2 million to meet Mr Milligan's future costs plus a lump sum in excess of £200,000 for pain and suffering. The compensation will be paid by the Motor Insurers Bureau. Counsel for the Claimant stated, 'We're very fortunate in this country that the Motor Insurers Bureau, which is funded by members of the Association of British Insurers, is there to pay awards such as this. Absolutely no-one in the UK goes unable to recover their compensation if the crash was caused by a motor vehicle. That's totally unlike America, where there are limits on compensation'.
Mr Lynch received 9 months in jail for road traffic offences.
