Brain Damages at Birth result in £5m compensation package

Darren Anderson, who is now 37 from Surrey, will receive a lump sum of more than £1.3 million and annual payments of more than £70,000 for the rest of his life.  His Solicitors and Experts believe he could live for many years to come.

The Court heard that in 1970, Mr Anderson suffered serious brain injuries at birth at St. Peter's Hospital, Chertsey, which resulted in him being disabled with cerebral palsy.  Mr Anderson's parents, Brian and Audrey Anderson, were wrongly informed at the time that they could not bring a claim for compensation against the hospital.  Then in 1999, a relative saw a newspaper article about a successful cerebral palsy claim brought many years after birth.  The issue of who was liable was finally resolved in 2007.

Mr and Mrs Anderson were commended by the Judge on the 'remarkable' job they had done in bringing up their son and said that the dramatic effect Darren's cerebral palsy had on his own life and those of his parents was clear.
