Case study 1

"A" was diagnosed with epilepsy and depression. "A" was in receipt of Disability Living Allowance, (DLA) Care Component and Mobility Component for a fixed period. Unfortunately, "A's" allowance was stopped due to an unfavourable medical report. "A" believed that there was no improvement in his condition. The PotterRees welfare benefits supervisor was instructed by "A" to appeal and we represented him at the appeal hearing. Our appeal was successful and he received both components of DLA once again. "A" also became entitled to Income Support and an increased amount of Housing Benefit and Council Tax Benefit. He also became eligible for a Community Care Grant from the Social Fund to cover essential domestic items.

Case study 2

"B" sustained a spinal cord injury. He was in hospital for a long time. PotterRees are handling his personal injury compensation claim. Our welfare benefits supervisor is advising "B" on an ongoing basis with welfare benefits and employment issues. Before "B's" discharge from hospital, PotterRees made sure that all welfare benefits issues were resolved as far as possible. Our advice covered many issues: a Disability Living Allowance, (DLA) challenge, the establishment of a Trust in which to hold personal injury compensation monies and protect means tested benefits, Carers Allowance and Social Services care assessment. We continue to provide ongoing help to "B" as the compensation claim continues.

Case study 3

"C" sustained a severe head injury in a car accident. PotterRees were successful in claiming substantial compensation for his personal injury. Our welfare benefits supervisor assisted "C" until he was satisfied that all of his relevant benefits issues had been concluded. On "C's" behalf, PotterRees successfully challenged the rate of Disability Living Allowance, (DLA) awarded and we applied for Income Support. Our application was successful as the compensation monies are held, in trust, by the Court of Protection. We were also successful in an award of Housing Benefit for "C" and we secured an exemption from Council Tax with the Local Authority for "C", by reason of severe mental impairment.
