Case study 1

"A" is a 23 year old man who suffered serious head injuries when he was knocked down by a car during childhood. His mother was initially appointed as his deputy but, as "A" got older, she felt that he should have more independence and so through PotterRees a professional deputy was appointed. "A" had made very good progress with his rehabilitation and was considered by the court to have “borderline mental capacity”. As "A" is capable of dealing with many aspects of his life, we allow him as much freedom as possible to make his own choices. However, we are acutely aware that this has to be balanced with the need to protect "A" from exploitation by others or from failing to understand the consequences of important decisions. A relationship of mutual trust has built up between the PotterRees deputy and our client to such an extent that we now act "in partnership". Before any action is taken, we discuss all the options and decide what is going to be done and who is going to do it.

Case study 2

“B” is a 15 year old girl with cerebral palsy. She is unable to communicate, a wheelchair user and requires 24 hour care. Her clinical negligence claim, against the hospital where she was born, is nearing completion. The Court of Protection team at PotterRees were approached to act as professional deputies. We have been appointed to liaise closely with the solicitor dealing with the claim, with “B’s” family and with the various professionals involved in her case. This is to make sure a suitable property is bought and to set up and fund a reliable care package. The appointment of PotterRees as professional deputies enabled “B’s” parents to concentrate on their role as parents and carers and we can deal with the paperwork involved in a cost effective way.

Case study 3

“C” is a man who unfortunately suffered multiple injuries as a result of a road traffic accident. “C” was awarded 50% of his compensation monies, owing to a finding of contributory negligence and so his funds are restricted. Initially “C’s” carer acted as his deputy but she found this too much combined with her caring role. PotterRees were appointed as professional deputies when our client purchased a property. The property required furnishing, decorating and also some general building work, which we as his deputy organised. PotterRees have also been able to secure for him increased welfare benefits and direct payments. We have worked together with “C” to set up procedures which work well between us and minimise costs.
